The Department of Education formally rescinded the Obama-era policies that instructed schools on how to handle Title IX sexual assault cases.
The announcement on Friday, September 22 came after Education Secretary Betsy DeVos’ announcement earlier this month that the department was working to change the federal guidance regarding these types of cases. Her department released a Q&A that outlines recommendations for schools and includes information on what schools are required to do when someone files a sexual assault claim.
The Department of Education also announced that they were formally withdrawing the “Dear Colleague Letter” that DeVos, among others, previously criticized for going too far. However, the Obama-era guidance requiring schools to investigate sexual assault allegations instead of handing the case off to law enforcement remains.
