WAIVER AND RELEASE FORM RELEASE OF LIABILITY In return for being allowed to participate in Living Paradigm CDC volunteer activities and all related activities, including any activities incidental to such participation (“Volunteer Activities”), the undersigned Volunteer or Parent/Legal Guardian of Volunteer if Volunteer is under age 18 (hereafter referred to using “I”, “me”, or “my”) releases and agrees not to sue Living Paradigm CDC or its officers, directors, employees, sub-contractors, sponsors, agents and affiliates (“Living Paradigm”) from all present and future claims that may be made by me, my family, estate, heirs, or assigns for property damage, personal injury, or wrongful death arising as a result of my participation in the Volunteer Activities wherever, whenever, or however the same may occur. I understand and agree that Living Paradigm are not responsible for any injury or property damage arising out of the Volunteer Activities, even if caused by their ordinary negligence or otherwise. I understand that participation in the Volunteer Activities involves certain risks, including, but not limited to, serious injury and death. I am voluntarily participating in the Volunteer Activities with knowledge of the danger involved and I agree to accept all risks of participation. I also agree to indemnify and hold harmless Living Paradigm CDC for all claims arising out of my participation in the Volunteer Activities.

I understand that this document is intended to be as broad and inclusive as permitted by the laws of the state in which the Volunteer Activities take place and agree that if any portion of this Agreement is invalid, the remainder will continue in full legal force and effect. I also acknowledge that Living Paradigm have not arranged and do not carry any insurance of any kind for my benefit or that of Volunteer (if Volunteer is under 18), my parents, guardians, trustees, heirs, executors, administrators, successors and assigns.

I represent that, to my knowledge, I am in good health and suffer no physical impairment that would or should prevent my participation in Volunteer Activities. I also understand that this document is a contract which grants certain rights to and eliminates the liability of Living Paradigm. In return for being allowed to participate in Living Paradigm CDC volunteer activities and all related activities, including any activities incidental to such participation (“Volunteer Activities”), the undersigned Volunteer or Parent/Legal Guardian of Volunteer if Volunteer is under age 18 (hereafter referred to using “I”, “me”, or “my”) hereby grants to Living Paradigm, and each of its subsidiaries, affiliates, agents, advertising or promotional agencies, and partners, and all such entities’ officers, directors, agents, employees, respective successors and assigns (collectively, “Authorized Parties”), the absolute and irrevocable right and permission to use, publish, broadcast and/or copyright the use of Volunteer’s name, address, voice, photograph and/or likeness, caricature, and personal information, in its current form or as retouched, digitized, cropped, altered, distorted or modified in any way, in any and all advertising, promotional, or other materials based upon or derived from the Volunteer Activities in any manner, in any media whatsoever for any and all purposes, including by way of example but without limitation advertising, promoting or publicizing products and services throughout the universe, in perpetuity, in any and all media now known or hereafter devised (including without limitation on the Internet), without additional compensation. I further agree that anything derived there from will be owned solely by the Authorized Parties. I shall not authorize the use of any print, negative or other copy thereof by anyone other than the Authorized Parties. I understand that this document is intended to be as broad and inclusive as permitted by the laws of the state in which the Volunteer Activities take place and agree that if any portion of this Agreement is invalid, the remainder will continue in full legal force and effect.

LIVING PARADIGM CDC is committed in all areas to providing an environment that is free from harassment. Harassment based upon an individual's sex, race, ethnicity, national origin, age, religion or any other legally protected characteristics will not be tolerated. All volunteers, employees, including supervisors and other management personnel, are expected and required to abide by this policy. If a volunteer feels that he or she has been harassed on the basis of his or her sex, race, national origin, ethic background, or any other legally protected characteristic they should immediately report the matter to the volunteer coordinator.

This Photo Release Form is made by and between the volunteer and LIVING  PARADIGM CDC  located at 4315 Yale Street , Houston, TX 77018.  
 
This form authorizes Living Paradigm (LP) to use your likeness in a photograph, video or other digital (media) in any and all publications, including grant reports, print or web-based publications to share the mission with other Donor Organizations, Sponsors, Homeowner’s and Families in need.  

This form authorizes LP to copy, edit, enhance, crop, or otherwise alter any media for use in publications. Signing this form also waives any rights for approval or inspection of any media used in publications. Homeowner understands and agrees that all media are the property of LP. Homeowner acknowledges that this Release has been entered into voluntarily, and homeowner is not entitled to any compensation or royalties with respect to Living Paradigm’s use of the Photos. Homeowner agrees to release and forever discharge Living Paradigm (LP) and its affiliates, successors and assigns, officers, employees, representatives, partners, agents and anyone claiming through them, in their individual and/or corporate capacities from any and all claims, liabilities, obligations, promises, agreements, disputes, demands, damages, causes of action of any nature or kind, known or unknown, which Homeowner, and anyone claiming on behalf of Homeowner, may have or claim to have against LP in connection with this Release. This Release shall be binding upon and inure to the benefit of the parties and their respective heirs, administrators, personal representatives, executors, successors and assigns. Homeowner has the authority to consent to the use and publication of the media. If any provision is held to be invalid or unenforceable, it shall not affect the validity or enforceability of any other provision. This Release constitutes the entire agreement between the parties and supersedes any and all prior oral or written agreements or understandings between the parties concerning the subject matter of this Release. This Release may not be altered, amended or modified, except by a written document signed by both parties. The terms of this Release shall be governed by and construed in accordance with the laws of the State of Texas. Homeowner has carefully read and fully understands all the provisions of this Release and is freely, knowingly and voluntarily entering into this Release.
