Design Concepts, Incorporated (DCI) is willing to provide you a non-exclusive, revocable, license to use for non-commercial purposes DCI's CAD files, engineering drawings, and other information on this website regarding push bike design (collectively, "Push Bike Materials"). This license includes the right to use the Push Bike Materials to create a push bike for your own, non-commercial, use. The license and your use of this website and Push Bike Materials are subject to the following terms and conditions, and by proceeding, you agree to these terms and conditions:
1. No Warranties; AS-IS. DCI makes no warranties regarding the Push Bike Materials, and you accept all Push Bike Materials "as-is" and "as-available". DCI hereby DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR PARTICULAR PURPOSE. Without limiting the foregoing, DCI hereby disclaims any warranty of non-infringement, regarding latent defects, or that the Push Bike Materials or use of this website will meet your requirements or expectations or be uninterrupted, secure, or error-free.
2. Assumption of Risk. You understand that: the Push Bike Materials have not been designed specifically for you; any use of the Push Bike Materials will be subject to the workmanship of the person using the Push Bike Materials, including the materials and tools used; any alteration of the Push Bike Materials in constructing a push bike may have unforeseen effects; and there are risks inherent in using the Push Bike Materials and in assembling and using a push bike. Therefore, you hereby assume all risks in using the Push Bike Materials and in assembling and using a push bike.
3. Limitation of Liability. DCI is making the Push Bike Materials available to you at no charge, but DCI is only willing to do so if you agree DCI shall have no liability with respect to the Push Bike Materials. Therefore, you hereby agree that DCI shall have no liability to you or your heirs, successors, or assigns with respect to the Push Bike Materials and the use of them, including no liability for direct, indirect, consequential, incidental, special, exemplary, punitive, or enhanced damages (including but not limited to physical injury and property damage) arising out of, relating to, or in connection with the Push Bike Materials, regardless of (a) whether such damages were foreseeable, (b) whether or not DCI was advised of the possibility of such damages, or (c) the legal or equitable theory (contract, tort, statutory, or otherwise) upon which the claim is based, and you hereby release and waive all such claims to the full extent permitted by law.
4. Indemnification. You hereby agree to defend, indemnify, and hold harmless DCI from any claims made by any third person arising out of or connected with your access to or use of the Push Bike Materials or a push bike constructed from them.
