STREET FAIR APPLICATION: FOOD VENDOR
The DDA Street Fair will be held on August 23 & 24, 2019 in downtown Grand Forks. This festival will showcase artisans representing the midwest and Canada. Stroll through the streets of downtown to view unique handcrafted artistry and purchase one of a kind finds. Fill up at the "downtown food court" with all your favorite foods and a few treats too!

On the Food Vendor form, if you selected to be the only food vendor for a certain type of food, other vendors will not be approved that have similar food items.

RULES & REGULATIONS
1. Participants must provide booth, props for display and be ready for extreme weather, wind, rain or heat.
2. Participants must use pop up tents in their booth spaces. A few exceptions may be granted with the explicit permission        
       of the GFDDA.
3. All products sold by the participant must be comparable in quality to the product photos submitted with application.
4.  The booth must be used by those who register for it.
5. The artists/crafter must be present in the booth for both days of the Street Fair.
6. The participant must stay for the entirety of the Street Fair - no breaking down early.
7. No blue poly tarps may be used in your booths.
8. All vendors are responsible for their own garbage removal. *A $50 Trash Fee is imposed on Food Vendors*
9. Storage of boxes, stock, should be organized in an orderly fashion within your booth.
10. Electricity is only provided in the "downtown food court" area(s). A few other exceptions may be granted upon request.
11. Cancellations must be done by June 1, 2019 for a full refund. AFTER June 1, 2019, you will forfeit your fees.
12. No smoking or alcohol in your booth at any time during the Street Fair.
13. There will be security overnight but the GFDDA is not responsible for damage or theft. Products should be secured or              
       removed from the booth at closing.
14. Location of booth is up to the event coordinators though every request will be considered.
15. All photos submitted grant the GFDDA permission to use for publicity and media promotions.
16. Participants cannot display materials depicting explicit violence or sexual conduct. GFDDA will be the final arbiters on
       the appropriateness of artwork.
BOOTH INFORMATION
1. Vendors are responsible for the safety, sturdiness, and protection of their displays in the event of gusty or other
       inclement weather. Canopies should be anchored; wind weights are strongly suggested. Anchoring into
       streets/sidewalks is not allowed.
2. Booths must not obstruct emergency vehicle pathways.
3. Tables must be fully skirted to conceal extra stock, boxes, or rubbish.
4. City regulations prohibit hanging signs or merchandise on trees and bushes and light poles; or altering public property in        
     any way such as drilling holes in sidewalks, buildings or planters.
5. All vendors are required to provide proof of liability insurance. (See Insurance section).
6. Trash must be contained and disposed of properly by the vendor. Use centrally located dumpsters to dispose of bags
       and boxes. Dumpster locations will be shown on the map.
7. All Vendors are expected to help keep the Street Fair clean by frequently policing their area.
8. The Street Fair Committee will inspect the booths following the close. Vendors will not be invited back if their space is
       not clean.
9. The Street Fair will be blocked off overnight and security provided. However, any merchandise or display units left will be
       at your own risk.
10. The GFDDA is not liable for damage, theft of the property owned or used by Street Fair participants.
11. The Street Fair Committee reserves the right to refuse any application for any reason and is under no obligation to rent
       space to a vendor in future years.
12. Vendors should be prepared for inclement weather. Tarps, wind weights, umbrellas, and warm clothing are              
       recommended. In the case of a severe weather incident, the DDA holds the right to cancel the Street Fair. No refunds
       will be given to vendors if this occurs.
13. No soliciting outside of the booth space.
14. All Food Vendors are requested to post food prices.
15. All Vendors are required to comply with City of Grand Forks and ND State health and safety requirements and to secure
       any necessary permits. It is your own responsibility as a food vendor to obtain your temporary restaurant license
       through the city of Grand Forks and have it submitted to GFDDA by July 31, 2019.
Insurance Requirements:
1. Certificate of Liability Insurance with $1,000,000 coverage for each occurrence
2. The Grand Forks Downtown Development Association must be listed as "additional insured"
3. The policy must cover the dates August 22-24, 2019

5. The certification must be on file with the GFDDA by July 31, 2019.

**We must have your Certificate of Liability Insurance before you will be allowed to set up for the Street Fair**
ND SALES TAX PERMIT
Each participant must obtain a North Dakota Sales and Use Tax Permit. We must have the permit # or a photocopy of this by July 31, 2019 or you will be unable to set up and participate in the Street Fair. (Please call or email the GFDDA if you need assistance with this). To get the appropriate paperwork, contact the North Dakota State Tax Commissioner: www.nd.gov/tax/salesanduse/ to get the forms you need or call 701-328-1246 with any questions

LEGAL AGREEMENT
1. By my submitting this application, I agree to abide by the rules and policies set forth in this application and to advise
       those persons working with me during this event of the same.
2. I agree to abide by all applicable North Dakota statutes, ordinances, regulations, and those of the City of Grand Forks
       and the Grand Forks Downtown Development Association. Specifically, I agree not to use or condone the use of drugs
       or alcohol within the event area and not to do any act that would constitute a breach of peace.
3. I agree to setup at the time, place and manner as instructed and to not tear-down until closing time or as otherwise
       directed. I also agree to not enter into vendor area with my vehicle until time stated in acceptance notification. Anyone
       not abiding by setup and tear-down rules will NOT be invited to return the following year.
4. I will maintain an inventory sufficient to cover my anticipated sales during the event.
5. I grant permission to the Grand Forks Downtown Development Association to use photos, slides, tapes or other visual
       representations of my booth and my products without compensation.
6. I am totally responsible for my booth and exhibited personal property including the method of display, method of set up,
       security for the protection of my property, sale of merchandise, takedown of the booth and disposal of trash. I will
       provide all materials for my booth.
7. I will provide Grand Forks Downtown Development Association with Proof of Insurance for $1,000,000 combined single
       limit commercial liability coverage by July 31, 2019.
8. I will set up my booth so that I respect the existing store owners, their window and entrance areas. I will not block such
       areas and I agree not to solicit outside my booth space.
9. In consideration of my use of the Downtown business area, I agree to indemnify and hold harmless the Grand Forks
       Downtown Development Association from any claims for damage to persons or property in any manner related to my
       use or occupancy of the Downtown area and event site. I release the Grand Forks Downtown Development Association
       from any liability for loss, damage, or theft of my property including damage or destruction to my booth.
10. I agree that once the Grand Forks Downtown Development Association has accepted my application, my application
       fee is not refundable.
11. Any proceeds derived from the sales of my product are entirely mine, and I am entirely responsible for collecting and
       remitting any applicable sales taxes.
12. I have secured any necessary permits or licenses for the use of any copyrighted or trademark materials and will
       indemnify and hold the Grand Forks Downtown Development Association from any claims of infringement.
13. The Street Fair Committee reserves the right to refuse any application for any reason and is under no obligation to rent        
       space to a vendor in future years.
14. I agree to clean and sweep my space. If trash is found at my location or my space is untidy after teardown, I may be
       subject to littering fines.

Any dispute with respect to this document or the materials furnished or in any way related to the DDA Street Fair 2019 will be resolved in Grand Forks, North Dakota whether by arbitration, mediation or litigation, and I submit to the jurisdiction of the Grand Forks County District Court with respect to any litigation. I have read and understand this agreement and materials furnished with this form and agree to abide by them. By my submitting this application, I hereby accept the terms and conditions stated within this application contract.

Registration checks and credit cards for accepted vendors are cashed/charged when applying to the show. Registration checks will be returned to vendors not accepted in the show.  If you apply, and are with in the dates of cancellation (BEFORE | JUNE 1, 2019), GFDDA will refund your booth fee.  After the dates of cancellation, the cancellation rules apply.
