RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT

WARNING: BY SIGNING THIS DOCUMENT YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. PLEASE READ CAREFULLY!

This Agreement must be completed by each individual attempting to participate in volunteer activities taking place at the rooftop farm on the Andrew and Valerie Pringle Environmental Green Roof on the George Vari Engineering and Computing Centre, and in the ground level gardens throughout Ryerson University.

ASSUMPTION OF RISK

I volunteer my services to the Ryerson Urban Farm free of charge and I am aware that participating in activities at Ryerson University's rooftop farm and ground-level gardens has many inherent risks, including but not limited to all manner of injury resulting from: falls on steep, icy, slippery or uneven terrain; exposure to cold, wet or windy weather, or the effects of heat and strong sunlight; use, misuse, non-use and failure of any equipment; transportation hazards; and any manner of injury resulting from falling and impacting against the ground or the roof. I freely accept and fully assume all such risks, dangers and hazards and the possibility of personal injury, death, property damage or loss, resulting therefrom, whether foreseen or unforeseeable.

I am aware that there are two beehives installed on the North-West end of the rooftop, and that while the bees have been selected for docile traits and tend to only sting when threatened, there is an associated risk of being stung by a bee or other insect.

I understand that I am obliged to acquire and use appropriate clothing and footwear to meet these risks. I also understand that it is my obligation to ensure that I am adequately trained to carry out the volunteer tasks assigned by Ryerson Urban Farm.

I understand that Ryerson Urban Farm may occasionally take pictures of its volunteers for use in promotional/advertising materials or publications (brochures, websites, newspaper ads, etc.) and that my photo may be used in such material.

CONDITIONS

1. I do not have any medical conditions that would prevent participating in the above mentioned activities activities on the rooftop farm and in the ground-level gardens.

2. I have adequate health insurance to cover the costs of treatment in the event of any injury.

3. I shall pay any attorney fees or costs incurred by the University in enforcing this Agreement.

4. If any portion of this Agreement is held to be invalid by a court of law, then it is agreed and intended that all the remainder shall, notwithstanding, continue in full force and effect.  

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT

In consideration of Ryerson University allowing me to access the Andrew and Valerie Pringle Environmental Green Roof, I agree as follows:

1. TO WAIVE ANY AND ALL CLAIMS, demands, lawsuits, costs, expenses including legal fees and disbursements that I have or may have in the future against Ryerson University, and its Board of Governors, officers, employees, students, agents, volunteers and independent contractors (all of whom are hereinafter collectively referred to as "the Releasees");

2. TO RELEASE THE RELEASEES from any and all liability for any loss, damage, injury including death, expense and any other liability of any kind including negligence, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE howsoever arising out of or in connection with my participation in accessing the Andrew and Valerie Pringle Environmental Green Roof;

3. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability for any damage to the property of, or personal injury to, any third party, resulting from my participation in accessing the Andrew and Valerie Pringle Environmental Green Roof; and

4. This Agreement is effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives in the event of my death or incapacity.

In entering into this Agreement, I am not relying upon any oral or written representations of statements made by the Releasees other than what is set forth in this Agreement.

Therefore, I hereby release Ryerson University, its officers, agents, employees and students from any and all claims and causes of action arising from injury or damage to or loss of property while volunteering my services to Ryerson Urban Farm.

I AM AT LEAST EIGHTEEN (18) YEARS OF AGE AND I HAVE READ AND UNDERSTOOD THIS AGREEMENT AND I AM AWARE THAT BY CLICKING "I AGREE", I AM WAIVING CERTAIN LEGAL RIGHTS TO WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS AND ASSIGNS MAY HAVE AGAINST THE RELEASEES.
