PHOTO RELEASE: Participant or Participant’s parent or legal guardian grants to Tennessee Tech University and its legal representatives and assigns the irrevocable and unrestricted right to use, sell and publish photographs of Participant, or photographs in which Participant may be included, for editorial, trade, advertising, and any other purpose and in any manner and medium; and to alter and composite the same without restriction and without Participant’s or Participant’s parent’s or legal guardian’s inspection or approval. Participant or Participant’s parent or legal guardian  hereby releases Tennessee Tech and its legal representatives and assigns from all claims and liability relating to said photographs.  There will be no refunds if the Golden Helix 5K cannot be staged or is cancelled for any reason. If enrolling a minor, a parent or legal guardian is responsible for supervising the minor during the event.    CONSENT, REPRESENTATION, RELEASE AND INDEMNIFICATION AGREEMENT:   If enrolling a minor, a parent or legal guardian is responsible for supervising the minor during the event. :Participant or Participant’s parent or legal guardian • fully recognizes that there are dangers and risks to which Participant may be exposed while participating in the Golden Helix 5K held Saturday, Oct. 29, 2016, at Prescott Hall on Stadium Drive.  • acknowledges that the activity may expose to hazards or risks that may result in illness, personal injury or death, including but not limited to, exposure to extreme temperatures;  hazards associated with running on a public street that is not closed to traffic;  physical exertion; unexpected road hazards such as bicycles or strollers pushed by runners; • understands and appreciates the nature of such hazards and risks and has had an opportunity to discuss those risks and hazards with the event sponsor; and • represents that Participant is in proper physical condition to participate in the event and has trained sufficiently for the completion of the open-road 5k walk or run. Race officials will ask any participant that the officials deem, in their sole discretion, to be wearing an unsafe mask or outfit to remove the unsafe article(s).  If the participant fails to remove the article(s), the race officials will disqualify the participant.  In consideration of and in return for the services, facilities, and the other assistance provided to Participant by Tennessee Tech University in this activity, Participant or Participant’s parent or legal guardian, on behalf of Participant’s parents/guardians and Participant and Participant’s executors, administrators and all others, releases Tennessee Tech University, the Tennessee Board of Regents and the State of Tennessee (“Releasees”) including their employees, volunteers and agents from any and all liability, claims and actions that may arise from injury or harm to Participant or damage to Participant’s property in connection with this activity. Participant or Participant’s parent or legal guardian understands that this release covers liability claims and actions caused entirely or in part by any acts or failures to act of Releasees, including but not limited to negligence, mistake, or failure to supervise by Releasees. Participant or Participant’s parent or legal guardian also agrees to indemnify Releasees for any liability, including attorney’s fees, for injury or death of any person and damage to property caused by Participant’s negligent or intentional act or omission.  Participant or Participant’s parent or legal guardian understands that Releasees do not have medical personnel available at the location of the activity and therefore grant Releasees permission to authorize emergency medical treatment, if deemed necessary by the event organizers. Participant or Participant’s parent or legal guardian agrees that Releasees assume no responsibility or liability for any injury or damage that might arise out of or in connection with such authorized medical emergency treatment. Participant or Participant’s parent or legal guardian further states that Participant or Participant’s parent or legal guardian has adequate health insurance necessary to provide for and pay for any medical costs that may be incurred during or arising from participation in this activity or, if not, will be fully responsible for any such costs.    By electronically accepting this agreement, Participant or Participant’s parent or legal guardian represents that s/he has read the entire document, fully understands it and agrees to be legally bound by it.  THIS IS A RELEASE OF LEGAL RIGHTS.  IF Participant is a minor, the person agreeing to these terms affirms that s/he has the legal right to consent and agree to the terms included in this document.
