Friends of the Earth not friends of the court

Justice Russell Juriansz of the Ontario Court of Appeal has refused to grant intervenor status to Friends of the Earth, an environmental activist group, in Smith v. Inco, the landmark decision granting millions in damages to homeowners whose properties were devalued by nickel emissions from Inco’s refining operations.
Both Celeste Poltak and Kirk Baert of Koskie Minsky, representing the respondent Ellen Smith; and Larry Lowenstein and Lauren Tomasich of Osler, Hoskin & Harcourt, representing Inco, opposed the intervention.
