Graft probe reports on Kenyans ministers ready

The fate of four suspended cabinet secretaries, a senator and an MP accused of graft will likely be known this week, after the Director of Public Prosecutions Keriako Tobiko received their files from the Ethics and Anti-Corruption Commission (EACC).

The four are Charity Ngilu (Lands), Kazungu Kambi (Labour), Felix Koskei (Agriculture) and Michael Kamau (infrastructure). Others are Nairobi Senator Mike Mbuvi Sonko and Lamu West MP Julius Ndegwa.

But suspended Energy Cabinet Secretary Davis Chirchir will wait much longer to know his fate as EACC is yet to complete the investigations in his case.

The DPP may either reject or accept the recommendations, or propose more investigations or closure of the files.

Mr Halakhe Waqo, the anti-graft agency Chief Executive said they would send the files to DPP today with the 60-day deadline set by President Uhuru Kenyatta also set to lapse today.

The individuals are among the 175 who were mentioned in the list of shame tabled in Parliament two months ago by the Head of State.

Waqo said they had finalised 56 files out of the 124 cases in the report, out of which 21 were forwarded to Tobiko who acted on them.

Waqo made the remarks at the EACC offices in Nairobi accompanied by his deputy Michael Mubea and other senior officials.

The file on the investigation where Kambi is accused of the irregular appointment of Mr Andre Gichanmba Muigai and Ms Veska Jepkemboi to the board of National Social Security Fund (NSSF) is complete, but another on his role in the controversial Tassia II housing project is not.

Ngilu is accused of conspiring with Likoni businessman Evanson Waitiki and valuers from her ministry to defraud the Government of Sh110 million over a land in Likoni, but two other investigations on the CS regarding land at State House Crescent and Karen in Nairobi are still under probe.

Kamau is accused of colluding with others to alter the design of the Kamukuywa-Kaptama-Kaptama-Kapsokwony-Kimilili road leading to massive embezzlement.

His two other cases involving construction of roads in Garissa and that of the railway are still pending.

The ready file on Koskei is on the alleged irregular leasing of Kenya Veterinary Vaccine Production Institute land in Tigoni, but he is also being investigated over sugar imports.

The commission said investigations of Chirchir as well as IEBC officials Issack Hassan and former CEO James Oswago are ongoing with regard to the so-called "Chickengate" scam.

Chirchir is also accused of embezzling Sh90 million at the Kenya Pipeline Company together with Sonko and others.

Ndegwa is accused of unilaterally awarding seven tenders to his cronies under the Constituency Development Fund.

Waqo said former Secretary to the Cabinet Francis Kimemia was cleared in only one case but is being investigated over the issuing of a Sh1 billion tender at the Interior Ministry and the sale of Kenya Railways Corporation houses.

He said that suspended Transport PS Nduva Muli's case in relation to the Standard Gauge Railways tender of Sh320 billion is still under probe and has international aspects.

Suspended defence PS Mutea Iringo is being investigated over claims he bribed members of the National Assembly's Public Accounts Committee (PAC).

Other top officials still under probe include Mining Principal Secretary Patrick Omutia and Investment Secretary Esther Koimett, but suspended Geothermal Development Corporation CEO Silas Simiyu's file will be forwarded to the DPP today.

EACC detectives have grilled four principle secretaries, two senators, 12 governors, and 11 senior Government officials, including heads of various parastatals.
