Acceptance of Terms and Conditions:
Consent: The undersigned hereby represents and warrants that he/she is the parent and/or legal guardian of the Participant and has the right and authority to make the following representations and releases on behalf of the Participant (collectively, the undersigned and the Participant shall hereinafter be referred to as the “Undersigned”). The Undersigned certifies that he/she may be photographed, videotaped or otherwise recorded by Super Kings Academy of Seattle and its subsidiaries and affiliates and their agents, Committee Members, sponsors, suppliers, insurers, directors, officers and employees (collectively, “Releasees”) in connection with the Event(s) (“Footage”). The Undersigned grants Releasees the sole and exclusive right, including the right to authorize others, to use and incorporate the Footage, in whole or in part, in conjunction with other photographs and footage, and the right to use the Undersigned’s name, voice, likeness and/or biographical information (collectively, “Likeness”) in connection with the exploitation, advertising, promotion and/or packaging of the Footage, the Event(s) or any future events similar thereto and/or any product into which the Footage may be incorporated, including but not limited to, radio, television, home video or other motion picture programs or sound recordings (“Products”) at such times and in such manner as Releasees may elect in perpetuity throughout the world, and to broadcast, exhibit and/or exploit the same in any and all media, whether now or hereafter known or devised. The Undersigned further acknowledges and agrees that Releasees shall be under no obligation to use or exploit the Footage and/or Likeness; that the Undersigned shall not be entitled to any payments, residuals, monies or other compensation arising out of Releasees’ exploitation of the Footage and/or Likeness in any manner, that the Undersigned hereby releases, discharges and agrees to save and hold harmless Releasees and/or its assignee from any and all claims of liability arising out of any use of the Footage and/or Products; and that the Footage shall be the sole and exclusive property of Releasees in perpetuity. In this regard, the Footage shall be deemed created for the benefit of Releasees as a work made for hire as defined in the United States Copyright Act of 1976.
Release and Waiver: THE UNDERSIGNED ACKNOWLEDGES THAT THE PARTICIPATION AND ACTIVITIES REQUIRED BY THE UNDERSIGNED IN
CONNECTION WITH HIS/HER PARTICIPATION MAY BE DANGEROUS AND MAY INVOLVE THE RISK OF SERIOUS BODILY INJURY, INCLUDING DEATH. THE UNDERSIGNED KNOWINGLY AND FREELY ASSUMES FULL RESPONSIBILITY FOR ALL SUCH INHERENT RISKS, INCLUDING DEATH, AS WELL AS THOSE DUE TO THE NEGLIGENCE OF RELEASEES.
THE UNDERSIGNED HEREBY RELEASES, WAIVES AND DISCHARGES RELEASEES FROM ALL LIABILITY TO THE UNDERSIGNED AND COVENANTS NOT
TO SUE RELEASEES FOR ANY AND ALL LOSS OR DAMAGE ON ACCOUNT OF INJURY TO THEIR PERSON OR PROPERTY OR RESULTING IN SERIOUS OR PERMANENT INJURY TO THE UNDERSIGNED OR IN THE UNDERSIGNED’S DEATH, WHETHER CAUSED BY THE NEGLIGENCE OF RELEASEES OR OTHERS UNDER CONTRACT WITH RELEASEES.
The Undersigned represents and warrants to Releasees that he/she is in overall good health, and no physician has advised him/her and he/she has no reason to believe that there is a medical reason for him/her not to participate in athletic competitions. By participating in the Event, the Undersigned is knowingly accepting this risk and specifically agrees that Releasees is not responsible for any condition that he/she may contract.
The Undersigned understands that this document is intended to be as broad and as inclusive as permitted by law and agree that if any portion of this Agreement is found to be invalid, the remainder will continue in full legal force and effect to the greatest extent permitted by law. The Undersigned waives all rights to trial in any action or proceeding instituted in connection with this release or the Super Kings Academy of Seattle activities. Any controversy or claim arising out of or relating to this release or the Super Kings Academy of Seattle activities shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party.
