ENTERTAINMENT FORM

Thank you for your interest in the BBFAA Pista Sa Nayon (Barrio Fiesta). PERFORMANCES ARE VOLUNTARY. If selected to perform, applicants will be scheduled on the stage deemed appropriate by the Entertainment Committee. The committee will provide all sound reinforcements (PA System). The performers are responsible for their own instruments and amplifiers. The Committee will not be able to provide drums, pianos, music stands, etc.
The Entertainment Committee seeks to present varied styles, types and genres of Filipino and of Filipino origin entertainment.

Miscellaneous Information:
Royalties, union fees, welfare, insurance, taxes, personal expenditures, operating or travel expense and other obligations are part of the cost of production and are the responsibility of the artist: therefore, the BIG BEND FILIPINO AMERICAN ASSOCIATION (BBFAA) and the CITY OF TALLAHASSEE shall not be responsible for the payment of these obligations. All performances are gratis, as a benefit to the community.

Contemplation of Proper Information:
If the artist and staff fail to provide up-to-date completed information on technical requirements or equipment in writing at least five (5) days prior to the event, then the agreement is terminated.

Failure to Perform:
In the event the artist is not ready to perform at the designated time or if vital performing member (s) is/are not present, or if the artist arrives at the performance in such a condition as to appear to a reasonable person to be incapable of performing in a contract, the Entertainment Committee, the BIG BEND FILIPINO AMERICAN ASSOCIATION (BBFAA) and the City of Tallahassee has the absolute right in its sole discretion to cancel the performance or terminate the performance in progress.

Reproduction Rights:
No portion of the stated performance shall be filmed, taped, recorded, reproduced or transmitted in an audio or video form without the written authorization of the artist except for the promotional purpose of this event.

Promotional Information:
Artist shall provide the Entertainment Committee with current promotional information and materials to be used for media and general promotion of the event.

Some Helpful Rules:

1) Check in with the stage manager at least 15 minutes before your group is to perform and give the sound person your music if applicable. As a performer, you are responsible for the quality of your music. Please test your music before coming to the event. BBFAA is neither responsible for any technical difficulties nor responsible for the safety of your device or CD during the performance.
2) Performers write their performance description on an index card to hand over to the Stage Emcee before actual performance. Spell out the word phonetically if it is in a foreign language.
3) If you have any announcements or costume changes during your show, make sure they are included in the time you have been given.
4) Wear shoes to protect your feet from hot stages and other debris.
5) Remember that your stage manager is in charge of your safety so please follow their directions.
6) The stage manager will cue you with a 2 minute warning sign to give you time to finish your demonstration or song.
7) Drink lots of water before and after your performance so you will not dehydrate.
8) Most importantly, have a great show and enjoy your performance!

LIABILITY DISCLAIMER AND HOLD HARMLESS AGREEMENT: PISTA SA NAYON - BARRIO FIESTA does NOT provide insurance for the protection of persons, vendors, entertainers, organizations or sponsors or others who participates in the PISTA SA NAYON - BARRIO FIESTA CELEBRATION at Kleman Plaza. In consideration of participating in the PISTA SA NAYON - BARRIO FIESTA FESTIVAL, I do hereby release and forever discharge PISTA SA NAYON - BARRIO FIESTA FESTIVAL for any and all actions, causes of actions, claims and demands for, upon or by reason of any damage, loss or injury, which hereafter may be sustained by me or my organization in consequence of participating in the PISTA SA NAYON - BARRIO FIESTA FESTIVAL at Kleman Plaza. This release, extended to, applies to, covers and includes all known, unknown, disclosed, unforeseen, unanticipated and unsuspected injuries, damages, losses and liabilities, and the consequences thereof, notwithstanding the provisions of any state, federal, local or territorial law or statute to the contrary, such provisions are hereby expressly waived. It is further understood and agreed that my participation in the PISTA SA NAYON - BARRIO FIESTA FESTIVAL at the Kleman Plaza is not to be construed as an admission of liability or the assumption of any responsibility of PISTA SA NAYON - BARRIO FIESTA FESTIVAL for the personal acts or omissions by me or those of my organization. I hereby agree on behalf of my heirs, executor, administrators, and assigns to indemnify PISTA SA NAYON - BARRIO FIESTA FESTIVAL and all members and officers of PISTA SA NAYON - BARRIO FIESTA FESTIVAL, jointly and severally and hold harmless from and against any and all actions, claims, demands and liabilities, loss damages and expense of whatever kind or nature, including attorney fees, which may at any time be incurred by reason of my participation in the PISTA SA NAYON - BARRIO FIESTA FESTIVAL at Kleman Plaza. *

CITY OF TALLAHASSEE LICENSE AGREEMENT AMERICAN SOCIETY OF COMPOSERS, AUTHORS AND PUBLISHERS (ASCAP): This letter is to inform you of certain limitations and requirements regarding the performance of music for PISTA SA NAYON (BARRIO FIESTA) under the City of Tallahassee's License Agreement with ASCAP for public performance of music written or published by ASCAP members. The license covers non-dramatic conditions of musical compositions (mechanical or live) limited to the ASCAP repertory (copyrighted by ASCAP members which ASCAP has the right to license for performance) on property owned or operated by the City of Tallahassee at events and functions conducted, sponsored or presented by or under the auspices of the City of Tallahassee. The City of Tallahassee contracts with PISTA SA NAYON (BARRIO FIESTA), which in turn contracts with you for PISTA SA NAYON (BARRIO FIESTA) - ENTERTAINMENT. Under this arrangement, the City of Tallahassee's license covers performances of music by ASCAP members as summarized above. To determine if a particular music is under the license, you may access the ASCAP database at www.ascap.com. Performance of musical works written or published by non-ASCAP members is not permitted unless the performer has obtained and provided proof of legal authorization to do so. If you will be performing such music, please sign and return the enclosed copy of this letter in acknowledgement of the limitation and requirement. By signature, the undersigned hereby acknowledges the requirements and limitations on performance of music as outlined above. If the undersigned performs musical works written or published by non-ASCAP members, proof of legal authorization for performance of that music must be attached to this letter of acknowledgement. *
