This cause came for hearing on July 7,2010, before the Hon. Jon Kerry Blackwood,

Senior Judge, upon written notice to the parties to appear for a scheduling

conference. It appearing to the Court that the defendants, respectively, understand

the charges pending against them, the following schedule is set for the proceeding

of this cause:

1. Defendant Huff having indicated to the Court his desire to file an affidavit of

indigency and defendant Fitzpatrick having indicated to the Court his intention to

hire counsel, both defendants shall advise the Clerk of the Court by July 23,2010, of

their choice of counsel, defendant Huff by filing of his affidavit if he so desires and

defendant Fitzpatrick by notice of appearance of counsel on his behalf. If either

defendant shall fail to so advise the Court by July 23,2010, he shall appear before

the Court at 9 a.m. in Madisonville, TN, on August 2,2010, to determine the status of

legal counsel.

2. All parties and their respective counsel shall file any and all motions or other

pleadings on their respective behalf no later than September 3, 2010, and serve

copies of the same on all other parties in interest to this cause as provided by the

Tennessee Rules of Criminal Procedure.

3. All motions or other pleadings filed on behalf of any and all parties shall be

heard by the Court beginning at 9 a.m. on October 5,2010, at Madisonville, TN.

All parties shall be prepared for hearing at that time in all regards.

4. Discovery shall be exchanged and available between the parties as provided

in the Tennessee Rules of Criminal Procedure.

5. The trial of this matter is set for November 29,2010, beginning at 9 a.m., at the

Courthouse in Madisonville, TN. All parties shall be prepared for trial at that time in
