The contest based on the film titled "The Sense Of An Ending" shall be conducted on May 19 & 20, 2017 on the TIMES NOW's Twitter profile i.e. '@TIMESNOW' (Times Now Twitter Handle) on Twitter The Contest will be run in accordance with and subject to Twitter terms and conditions.
1. To participate in the Contest, Participant should be a citizen of India. Employees, directors, and/or officers (including immediate family members or members of the household) of BCCL employees, officers, consultants, or agents including that of its subsidiaries, affiliated companies, distributors, advertising, fulfillment and promotion agencies and all other companies or entities associated with the Contest are not eligible to participate. 2. During the Contest Period, BCCL will post Questions (each a Question) on the Times Now Twitter Handle on a daily basis or as deemed appropriate by BCCL on any day of the Term. Each Question will be an open-ended subjective question based on the Film and/or any other aspect related to the Film. 3. To participate in the Contest, all interested users are mandatorily required to follow the following process in sending their respective answers:
a. Log in to the Platform using his/her Twitter account/credentials and click on the relevant page/tab of the Contest on the Platform or in any other manner or form as may be prescribed/requested on the Platform. For the purpose of participating in this Contest, it is mandatory that the interested Participant (s) mandatorily have a valid Twitter account and must be residing in India during the Period of the Contest.
b. Follow the TIMES NOW Twitter Handle on the Platform.
c. Participant (s) shall thereafter be required to answer all the Questions on the Platform by tweeting all the answers by using the pre-created Hash Tag, "#The Sense Of An Ending", ("Answer"). For the avoidance of doubt it is clarified that each and every Answer should mention the pre-decided hashtag (as stated above) and TIMES NOW Twitter handle as mentioned on the Platform.
d. Submit their full name, email id, the name of their city where they reside, contact number(s), etc. as requested on the Platform in a manner and form, as may be requested and /or prescribed on the Platform ("Personal Information").
e. For purposes of the Contest, "receipt" of Answer(s) occurs only when the website server records the Answer information upon the entrant clicking "Submit/Post" button. For sake of clarity, any automated receipt confirmation shall not constitute proof of actual receipt. Logging onto the Platform in the manner as stated hereinabove, mandatorily have a valid Twitter account and being a resident of India during the Period of the Contest, following the TIMES NOW Twitter Handle, tweeting the Answers for all the Questions of the Contest, Re- tweeting all the Questions of the Contest by the Participant(s) with the pre- decided hashtag on the Platform, furnishing the Personal Information shall be considered as a complete and valid entry ("Entry"). For the avoidance of doubt, if the Participant(s) provides or tweets any Answer without the pre- decided hashtag or re- tweets the Question without the pre- decided hashtag or fails to furnish Personal Information or if the Participant does not have a valid twitter account or is not resident of India then his/her Entry shall be considered incomplete and the Participant(s) shall be ineligible for the Prize. The Participant (s) agrees and acknowledges that by submitting the Entry and/or Answer(s) the Participant(s) is representing that the Entry(s) and/or Answer(s) or contents thereof are not confidential or comprise any sensitive personal information. It is further clarified that the Participant(s) cannot make (a) blank tweet using just the pre-decided hashtag (b) offensive/abusive tweet (c) tweeting and re-tweeting the same Answer more than once (i.e., making the same tweet many number of times in order to be selected as winner (d) tweets which do not make any sense (irrelevant to the Film and /or the Contest). Any Entry comprising of such tweets and/or Answers shall be considered null and void and shall not be eligible for the Prize.
4. For every Question, the First correct answer received by BCCL will be selected and declared as the winner for the said Contest Question. The winner will be entitled to gratification in the form of Two movie theatre tickets for the Film from BCCL (Prize). The Prize will be in the form of e-codes redeemable only against the movie theatre tickets for the Film within the validity period and location mentioned therein.
5. The winner would be contacted through direct message (private message) by BCCL through the Platform or by calling them on his/her mobile number provided by them. On direct message (private message), Participant(s) would be asked to share their Contact Details (Name, Address and Phone no.) on specific e-mail id. Each Participant/Winner consents to the use of information supplied by the Participant for the purposes as set out in these Rules and Regulations. For the avoidance of doubt it is clarified that BCCL’s decision in regard to the selection and declaration of the Winner(s) shall be final and binding. For the sake of clarity, mere participation in the Contest does not entitle the Participant(s) to win the Prize. Only the Participant having made a valid Entry and who are shortlisted and declared as Winner(s) based on the criterion mentioned hereinabove, by BCCL at its discretion shall be entitled to the Prize. It is further clarified that save and except the Prize stated hereinabove, the Participant/Winner shall not be entitled to any other form of gratification (monetary or otherwise). Entries sent after the Period will not be considered for the Contest and shall be deemed null and void.
6. BCCL shall get in touch with the Winners and will explain to them the process to be followed to collect the Prize. If the winner fails to collect or receive the Prize as per the process shared by BCCL for collecting the Prize then, the Winner shall forfeit its claim on the Prize and BCCL shall select a new winner from the Participants at its sole discretion.
7. The Winner will be selected through an automated system without any human intervention. BCCL’s decision on selection of the Winner of the Contest shall be final and binding. BCCL shall not entertain any questions, enquiries on the manner/method of selection of the Winner and any other question relating to the Contest from any party whatsoever. All the Entries will be stored in a backend system operated by BCCL and/or any person/agency appointed by BCCL.
8. Participant agrees that he/she shall enter this Contest at their own will and BCCL is not in any way obligated or liable for any loss or costs that Participant may suffer or incur and nothing is payable to the Participant for participating in the Contest.
9. The Prize is non-transferable, non-assignable to any other person, party or organization. There is no cash substitution, cash redemption or cash value in lieu of the respective prize.
10. BCCL reserves the absolute right to disqualify any Participant, if it is of the opinion that he/she has used improper technical means to participate in the Contest, or due to any other valid reason that may nullify his/her Participation in the Contest. BCCL’s decision on any dispute in relation to the Contest shall be final and binding on the Participant.
11. BCCL, its directors, employees, affiliates, agents and representatives shall in no manner whatsoever shall be responsible and/or shall not be held liable for any damage or loss (including but not limited to indirect or consequential loss) arising from personal injury, death, mental trauma or loss of, or damage to property, caused to the Participant (including the Winner) or any party sustained in connection with the Contest or the Prize related to the Contest.
THIS CONTEST, PRIZE AND OTHER RELATED OR INCIDENTAL SERVICES THERETO ARE PROVIDED ON AN "AS IS" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BCCL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES IN RESPECT OF THE PRIZE, OPERATOR SERVICES. WITHOUT LIMITING THE FOREGOING, BCCL SPECIFICALLY DISCLAIMS ANY WARRANTY (A) THAT THE WEBSITE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, (B) THAT DEFECTS WILL BE CORRECTED, (C) THAT THE SECURITY METHODS EMPLOYED TO PROTECT THE DISCLOSURE OF INFORMATION WILL BE SUFFICIENT, AND (E) REGARDING CORRECTNESS, ACCURACY, OR RELIABILITY.
PARTICIPANT AND/OR ANY PARTY (“VISITOR”) THAT ACCESSES THESE SERVICES AGREE THAT NEITHER BCCL NOR ITS THIRD PARTY CONTENT OR SERVICE PROVIDERS WILL BE LIABLE FOR ANY LOSS OR DAMAGES, EITHER ACTUAL OR CONSEQUENTIAL, ARISING OUT OF OR RELATING TO THESE TERMS, VISITOR'S USE OR INABILITY TO USE THE SERVICES MENTIONED HEREIN. IN PARTICULAR, NEITHER BCCL NOR ITS THIRD PARTY CONTENT OR SERVICE PROVIDERS WILL HAVE LIABILITY FOR ANY CONSEQUENTIAL, INDIRECT, PUNITIVE, SPECIAL OR INCIDENTAL DAMAGES, WHETHER FORESEEABLE OR UNFORESEEABLE (INCLUDING, BUT NOT LIMITED TO, CLAIMS FOR DEFAMATION, ERRORS, LOSS OF DATA, OR INTERRUPTION IN AVAILABILITY OF DATA), ARISING OUT OF OR RELATING TO TERMS OF USE, VISITOR'S USE OR INABILITY TO USE THE SERVICES, WHETHER BASED IN CONTRACT, TORT, STATUTORY OR OTHERWISE.
12. By participating in the Contest Participant permits BCCL to use the answers posted by him/her and his/her information on any media/Social Media platform, any other multimedia activation/event and/or which shall include trade publications, press releases, electronic, Channel website, the BCCL website, the Channel, any other media property or any display format selected, owned or controlled by BCCL.
13. Participant hereby indemnifies BCCL, its employees, officers, directors, contractors, contest partners, contest sponsors in relation to this Contest and hold them harmless against any loss, claim, demands, costs, damages, judgments, expenses or liability (including reasonable legal costs) arising out of or in connection with any or all claims, that may be brought against BCCL by any third party in connection with Participant’s participation in or winning the Contest, which is inconsistent with any of the representations made by Participant due to any willful misconduct, fraud or malfeasance and shall reimburse BCCL for any such loss, costs, expense, or damage to which said indemnity applies. BCCL shall give the Indemnifying Parties prompt written notice of any claim or actions covered by this indemnity, and Indemnifying Parties shall have the right, at its own expense, to participate in any such action.
14. The courts at Mumbai shall have the sole and exclusive jurisdiction in all disputes arising out of this Contest or relating to the use of the BCCL services for this Contest.
These terms and conditions (Terms) are applicable and govern the contest based on the film titled "The Zookeeper's Wife" (Film) organized by the Television Division of Bennett, Coleman and Company Limited (BCCL) for its English News Channel 'TIMES NOW' (Contest). TIMES NOW shall hereinafter be referred to as "Channel". This Contest is based on the Film. For the purpose of this Contest, any person who participates by way of answering the question will be treated as a participant (Participant/Viewer). By participating in the Contest, Participant agrees to abide by and be bound by these Terms. BCCL reserves the right to modify these Terms without any prior notification.
Participant is advised to regularly review these Terms. If Participant does not agree with any of the Terms and any amendments thereto, he/she must not use this site/service and/or participate in the Contest. The participation to the Contest is solely voluntary.
