ARTIST AND HUMAN RIGHTS ACTIVIST ARBITRARILY BEING DETAINED IN A CUBAN PRISON WITHOUT CHARGES

Cuban Artist and Human Rights Activist Danilo Maldonado Machado artistically known as ‘El Sexto’ – named a prisoner of conscience by Amnesty International in 2015 – has been jailed again without charge in Cuba. On November 26, shortly after the announcement of Fidel Castro’s death the artist spoke about the deceased leader in a video and made a small piece of graffiti art in reference to the passing with the words, "se fue" he has gone.

At 11:15 am of the same day, he was taken by force by Cuban state police without arrest warrant, charge or explanations from his home in Havana. Danilo Maldonado Machado, El Sexto, was on the phone with his girlfriend when state officials forced their way into his apartment, where witnesses reported he was dragged and beaten as they removed him without explanation.
 
According to his mother, Maria Victoria Machado, she and his sister were initially unable to locate him for three days. Authorities never provided them with any clear information as to his whereabouts nor what had happened. He was eventually found in a prison, arbitrarily held without charge. When Maria Machado visited him officials did not give reasons for his arrest and he is still being held without charges.

Allowed a 5 minute visit with her son, she reported he had been beaten, had suffered an Asthma attack during the ordeal, had not been provided with medical care, and reports he felt ill after eating at the jail have led to the disclosure that his food had been laced with sedatives. Currently Danilo Maldonado Machado, El Sexto, is not eating prison food due to this revelation and only eating when and if his Mother is allowed to provide him food. Which at this time, is once a week. Through all of this Danilo remained at the time in strong spirit and assured of his continued stands for human rights.

Since the detention began, he has been moved to a notoriously dangerous prison where human rights abuses occur daily and lack of water, hygiene and other grave problems are known to happen. His head has been shaved by authorities at the prison. His phone use has been revoked after a reporter from Canada attempted to interview him over the line. This has further isolated him from any outside communications.

Amnesty International, Human Rights Watch, Oslo Freedom along with many have joined in asking for the immediate release of Danilo Maldonado Machado, "El Sexto", from this arbitrary detention in Cuba and calling him a prisoner of conscience.

Short-term arbitrary arrests remain a common tactic to restrict freedom of expression in Cuba. In October, the Cuban Commission of Human Rights and National Reconciliation, which like other human rights organizations is not recognized by Cuban authorities, reported 620 arbitrary detentions of peaceful protestors and opposition activists. Provisions of the Cuban Criminal Code, such as contempt of a public official (desacato), resistance to public officials carrying out their duties (resistencia) and public disorder (desórdenes públicos) are frequently used to stifle free speech, assembly and association.

Danilo Maldonado Machado, El Sexto, is internationally known for his Graffiti Art, Fine Arts and his Human Rights Activism and speaking engagements. He is the recipient of the prestigious Václav Havel Prize for Creative Dissent and has spoken openly about the intense lack of freedom of speech and lack of human rights in Cuba via many outlets including the documentary HBO film Patria o Muerte.

DEFENSOR DE DERECHOS HUMANOS Y ARTISTA DETENIDO SIN CARGOS EN CUBA

El artista cubano, Danilo Maldonado Machado, conocido como El Sexto y catalogado como prisionero de conciencia por Amnistía Internacional en el 2015, fue detenido de nuevo el 26 de noviembre, poco después del anuncio de la muerte de Fidel Castro. El artista opinó sobre el dictador fallecido y pintó una pequeña pieza de graffiti haciendo referencia a la muerte del Sr. Castro, con las palabras, “se fue”.

El 26 de noviembre a las 11:15 A.M. fue forzosamente sacado de su hogar en Habana por fuerzas policiales, sin explicaciones o cargos. Danilo estaba hablando por teléfono con su novia cuando los policías entraron en su casa, lo arrastraron y se ha reportado, fue golpeado en el proceso de detenerlo.

Según su madre, María Victoria Machado, ella y la hermana del artista pasaron 3 días sin poder localizarlo. Las autoridades nunca les dieron información clara. Cuando por fin lo encontraron en una prisión cubana, no tenían récord oficial de su arresto. Cuando María Machado lo visitó, los oficiales tampoco dieron razón y aún no hay cargos en su contra.

En los 5 minutos que pudo hablar con su hijo, se veía visiblemente golpeado, su hijo Danilo le informó que había sido golpeado y que había tenido ataques de asma desde su arresto y no había tenido la asistencia médica pertinente. Danilo también dijo sentirse enfermo después de comer en la cárcel, lo que le ha llevado a ser enterado que su comida estaba contaminada con sedantes. Actualmente Danilo no está comiendo a causa de esta revelación si no es la comida que su madre le provee, si se lo permiten – hasta el momento ha sido una vez por semana. A pesar de todo, Danilo se mantiene fuerte y asegura que seguirá trabajando por los derechos humanos en Cuba.

Durante su detención sin cargos ha sido movido a una prisión conocida por sus violaciones de derechos humanos, cortes de agua y poca higiene. Su pelo fue rapado por las autoridades y su uso de teléfono quitado tras ser contactado por ese medio por la prensa canadiense.

Los arrestos arbitrarios de poca duración siguen siendo una táctica común para restringir la libertad de expresión en Cuba. En octubre, la Comisión Cubana de Derechos Humanos y Reconciliación Nacional, como otras organizaciones similares, reportó 620 detenciones arbitrarias a protestantes pacíficos y activistas opositores.
Las tipificaciones de desacato, resistencia y desorden público en el Código Penal Cubano son en las que frecuentemente se basa el régimen para reprimir la libertad de expresión, asociación y reunión.

Amnistía Internacional, Human Rights Watch y Oslo Freedom han hecho llamados para su liberación inmediata.
